我国城管综合执法冲突的类型及管理策略——基于街头官僚理论的视角

Types and Management Strategies of Conflicts in Chinese Chengguan’s Comprehensive Law Enforcement: On the Perspective of Street-Level Bureaucracy Theory

摘   要:城管处于政策执行末端,掌握一定的自由裁量权,与民众直接打交道,具有街头官僚的典型特征。我国城管综合执法的冲突主要有四种类型:城管执法者自我角色定位的冲突、城管执法者与行政管理相对人的冲突、城管执法者与城管综合执法体制的冲突、城管执法者与其他相关政府部门的冲突。对执法冲突的管理,可以从整合碎片化的组织机构、打造精细化的管理机制、搭建系统化的治理体系、培育法治化的城管氛围四个方面展开。

Abstract :Chengguan(urban management officials)are at the end of policy implementation,who get hold of some discretion and directly deal with the people with the typical characteristics of street-level bureaucracy. There are four types of conflicts in Chinese urban comprehensive law enforcement: the conflict in urban management officials’ self-positioning; the conflict between urban management officials and administrative counterparts; the conflict between urban management officials and urban comprehensive law enforcement system; the conflict between urban management officials and other government departments. In order to manage these conflicts, action can be taken as follows: integrating fragmented organizations; refining management mechanisms; systematizing governance system; cultivating urban management atmosphere under rule of law.
