新时期规划工作地方立法创新思考——以北京为例
Innovation on Local Legislation of Planning in New Era: Taking Beijing as an Example

摘要 文章首先回顾了北京规划工作地方立法的历程，从历史的角度把握地方立法工作的特点和趋势；接着从国家治理现代化背景下的制度改革新方向、城市发展进入存量时代对制度建设提出的新要求、超大城市治理难题对城市治理带来的新挑战、规划体制机制自身存在的问题等方面，分析了当前规划工作地方立法面临的主要任务和挑战；然后从价值追求与问题导向、突出重点与统筹平衡、原则规定与具体细化、突破创新与留有余地等方面，提出了新时期规划工作地方立法应处理好的几个关系；最后从推动空间治理现代化出发，基于系统化、法治化、科学化、民主化等原则，从重构规划“编审管”体系、健全规划制度保障、创新规划思路方法、完善城市治理体系等方面，提出了规划工作地方立法创新的主要内容。

Abstract This paper first takes Beijing as an example to review the process of planning local legislation, to grasp the characteristics and trend of local legislation from a historical point of view. Then, it analyzes the main tasks and challenges of the current planning local legislation from the following aspects: the new direction of institutional reform under the background of national governance modernization, the new requirements of stock renewal system during the city development, the new challenges of mega city governance, and the problems of planning system and mechanism. After that, from the value pursuit and problem orientation, focus and legislative balance, clear direction and specific refinement, innovation and leave leeway, the paper puts forward several relations that should be handled well. Finally, starting from promoting the modernization of space governance, based on the principles of systematization, legalization, scientization and democratization, this paper puts forward the main contents of planning local legislation innovation from the aspects of reconstructing the management system of planning compilation, improving the planning system, innovating planning ideas and methods, and improving the urban governance system.
