国土空间规划立法相关问题刍议
Discussion on Issues Related to Legislation on Territorial Spatial Planning

摘要 我国的国土空间规划有着过去 40 年城镇化推进若干类型规划发展的工作基础和“多规合一”的实践经验，是中共中央领导的一项站位高、定位准的行政体制改革工作，也是规划行业的一次彻底变革。体系构建最重要的一步自然是立法工作。本文从城市规划专业角度，审视了当前阶段学术研究领域和业务活动中存在的若干主要问题，分析了与其相关的立法考虑；并基于生态文明建设的顶层设计和以人为中心的发展理念，对国土空间规划立法的要点和内容进行了研究，以立法逻辑、现实需要和发展趋势为出发点，提出了国土空间规划立法的三个关键工作方向，并论述了各方向的工作原则和主要内容。

Abstract It is a profound reform of planning industry in administrative system led by Central Committee of China with 40-year urban planning experience and planning integration practices. Territorial spatial planning enters the new era. Legislation is the essential step to establish the new system. This essay went through main issues of current academic research and business activities correlated to urban planning. Based on the top-level design of ecological civilization construction and the concept of human-centered development, the main points and contents of the legislation of territorial space planning were studied. Based on the realistic needs and development trend of legislation logic, this paper put forward three key working directions of legislation on territorial spatial planning, and discussed the working principles and main contents of each direction.
